END USER LICENSE AGREEMENT



1. LICENSE

The Licensor (Nextart Technology LLC - DBA Sampleson) hereby grants to the User a non-exclusive license to: (a) Install 2 copies of the Software; (b) Use 10 instances of the Software.

1.2. The User shall be responsible for the security of copies of the Software supplied to the User under this EULA and shall use all reasonable endeavors (including all reasonable security measures) to ensure that access to such copies is restricted to persons authorized to use them under this EULA.

1.3. Nothing in this EULA shall give to the User or any other person any right to access or use the Source Code or constitute any license of the Source Code.

2. COPYRIGHT.

All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, clipart, libraries, and examples incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by the Author of this Software. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material.

2.1 The licensed users or licensed company CAN USE: all functions, sounds and effects in the SOFTWARE PRODUCT to create new music production, live music performances, create recordings to release commercially that contain a performance using the instruments, use virtual instruments in combination with other sounds within music compositions/productions and release the final product (music) commercially.

2.2 The licensed users are NOT ALLOWED TO: distribute copies of the Software to others. Rent, lease or grant sub-licenses or other rights to the Software without the prior written consent of Sampleson. Resampling OR soundpacking Sampleson’s Virtual Instruments or any sound generated by them. Reverse engineering to source code. Translate or otherwise alter the Software without the prior written consent of Sampleson

3. NO WARRANTIES. The Author of this Software expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.

4. NO LIABILITY FOR DAMAGES.

In no event shall the author of this Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of this Software is aware of the possibility of such damages and known defects.

5. LEGAL DISCLAIMER ON THE USE OF MIDI FILES

This software uses a Markov-based algorithm to generate melodies and chords inspired by MIDI files provided by the user. The resulting music is not a direct copy of the input MIDI but a new creation derived from statistical patterns.
It is the sole responsibility of the user to ensure that any MIDI file used within the software has the necessary rights for use, distribution, or modification. The developer of this software assumes no responsibility for the improper or illegal use of copyrighted MIDI files.
By using this software, the user acknowledges that any legal consequences resulting from the use of copyrighted MIDI files will be their sole responsibility.
If you are unsure about the rights to a MIDI file, we strongly recommend consulting with a legal advisor before using it within the software.

6. LICENSE FOR THE USE OF INLCUDED MIDI FILES.

The MIDI files from the 'Classical' folder are licensed under the CC-BY-SA Germany License. This means you can use and adapt the files as long as you attribute the copyright holder as follows:

The distribution or public playback of the files is only allowed under identical license conditions.
The scores are open source.

Any MIDI file not located in the 'Classical' folder are free for commercial and personal use without restrictions.
